2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30 / 30(a) of the Bihar Prohibition and Excise Act.

3 . As per prosecution case , 30 litres country made liquor has been recovered from open place .

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has been made accused only on suspicion . Recovery has been made from an open place , accessible to one and all. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition .

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.7763 of 2025(2) dt.03-03-2025 2/2 of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Exclusive Special Excise Judge, Saran at Chapra in connection with Sonepur (Pahleja OP) P. S. Case No. 166 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure .
