2. The petitioner seeks regular bail in connection with Atri P.S. Case No. 68 of 2023, lodged on 14.02.2023 under Sections 376, 493, 504, 34 of the Indian Penal Code.

3. As per the prosecution case, FIR has been lodged against five named accused persons including the present petitioner. The allegation against the present petitioner is that he has developed physical relation with the informant on the pretext of marriage and when the informant pressurized the petitioner for marriage, he refused.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel

No.13207 of 2024(3) dt.18-04-2024 2/3 also submits that case diary as well as statement under section 164 Cr.P.C. has been called for and in statement under section 164 Cr.P.C., the victim has supported the prosecution story. Counsel further submits that initially the petitioner' side were ready for marriage, but when they acknowledged that the informant has already filed a similar nature of criminal case bearing Arti P.S. Case No.190/2022 on other accused and extracted money from them, then the petitioner's side denied the proposal for marriage.

5. Learned counsel for the petitioner submits that the criminal antecedent of the petitioner is clean and he is in custody since 25.11.2023.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

7. Learned counsel for the informant vehemently opposes the prayer for bail of the petitioner and submits that the petitioner is telling lie.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
