JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Petitioner being elder brother of the husband of the victim is languishing in custody since 04.07.2014 in a case registered for the offences punishable under Sections 304(B) of the Indian Penal Code.

The accusation is killing the daughter of the informant after one year of marriage.

It is submitted by learned counsel for the petitioner that during investigation it transpired that the victim fought with her husband for celebrating the marriage anniversary at her parents' house and subsequently committed suicide by locking the door from inside. This fact has not been controverted by learned A.P.P. after going through the case diary that the lock of the door was broke opened when the victim was found hanging.

Considering the fact that husband and father-

Patna High Court Cr.Misc. No.46942 of 2014 (4) dt.28-04-2015 2/2 in-law of the victim have been granted bail vide Cr. Misc. Nos. 43246 of 2014 and 46022 of 2014, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 3rd, Samastipur in connection with Kalyanpur P.S. Case No. 761 of 2014, arising out of Sessions Trial No. 313 of 2014. (Dinesh Kumar Singh, J) Shageer/- U T
