In the instant petition, petitioner has prayed for following reliefs:- " That this writ application is for quashing the letter no. 2369 dated 30.08.2016 (Anneuxre-8) issued by the District Manager, Bihar State Food & Civil Supplies Corporation Limited, Samastipur whereby he decide the tender for appointment of contractor for door step delivery of food grain of Bihar State Food and Civil Supplies Corporation Limited for the Samastipur District, on the basis of wrong interpretation of clause 9 (ix) of the terms and condition of tender by the Managing Director, Bihar State Food and Civil Supplies Corporation Limited, Patna vide letter no. 10224 dated 12.08.2016.

For any further proceeding done by the authority in consequence with letter no. 2369 dated 30.08.2016 be quashed.

For selection of petitioner as door step delivery agent of Bihar State Food and Civil Supply Corporation Limited for Samastipur District since petitioner fulfilled all the require criteria let down in the terms and condition of tender and the rate offer by the petitioner is Rs. 28 per quintal and the rate offer by the selected contractors in Rs. 38 per quintal which amounting huge loss/extra payment of the public money to the selected contractor."

3. There is no interim order.

4. Learned counsel for respondent on instruction submitted that contesting respondents have already executed the

5. Accordingly, the present petition stands disposed of as it has become infructuous.
