2. The petitioner seeks bail in connection with Bakhtiyrarpur PS Case No. 547 of 2023 instituted for the offences punishable under Sections 323, 341, 307, 504, 506/34 of the Indian Penal Code

3. As per the prosecution case, three persons including the petitioner with bad intention knowingly thrown piece of bricks from the roof and injured informant's son.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He next submits that the informant is own aunt of the petitioner and due to family partition dispute the petitioner has been made accused in this case for revenge. There is general and omnibus allegation

Patna High Court CR. MISC. No.12174 of 2024(2) dt.05-03-2024 2/2 against the petitioner. Petitioner is in judicial custody since 14.12.2023.

5. Learned APP opposes the prayer for bail.

6. From perusal of the FIR, case diary and the impugned order of the learned Additional District and Sessions Judge-1st, Barh, Patna dated 16.01.2024, it appears that there is general and omnibus allegation against the petitioner and due to previous family partition dispute he has been implicated in this case accordingly, the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- III, Barh Patna in connection with Bakhtiyarpur PS Case No. 547 of 2023.
