2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 103(2), 80 and 61(2) (a) of the B.N.S.S. registered in connection with Majhaulia P.S.Case No. 606 of 2024.
3. The deceased is daughter of the informant Sayra Khatoon. According to her fardbayan, the marriage of her daughter was solemnized with co-accused Jahid Alam. The accused persons started demanding dowry and her daughter (the deceased) filed a case being Sikta P.S.Case No. 95 of 2024. Thereafter, the matrimonial inmates of the deceased made pressures for withdrawal of the said case. Her daughter was ready to withdraw the case on the condition that she may be
Patna High Court CR. MISC. No.9120 of 2025(5) dt.14-05-2025 2/3 allowed to reside in her matrimonial house, but the accused persons did not allow her to reside in her matrimonial house. She was residing in her myke. In the night of 11.10.2024 at about 11.30 p.m., Nazir Alam @ Nazir, who is Devar of the petitioner, entered into her house and inflicted knife blows on the deceased. Her father attempted to catch hold of the accused, but he fled away. She died on way to the hospital. It has been mentioned that the accused persons, named in the FIR, including the present petitioner, had hatched a conspiracy to murder his daughter.
4. The learned counsel for the petitioner has submitted that the petitioner is sister-in-law (Nanad) of the deceased. The FIR shows that there is specific allegation on Nazir Alam @ Nazir of inflicting knife blows on the deceased. She has falsely been implicated, because she is Nanad (sister-in-law) of the deceased having no concern with day-to-day affairs of the deceased. She is under custody since 13.10.2024.
5. On the other hand, the learned counsel for the informant opposed the prayer for bail by submitting that the petitioner and other accused persons, prior to the occurrence, had tortured the victim for which she had filed Sikta P.S.Case No. 95 of 2024. Later on, she was murdered.

6. The FIR shows that Nazir Alam @ Nazir inflicted knife blows on the deceased and committed her murder. So far as the present petitioner is concerned, she is Nanad (sister-inlaw) of the deceased and no specific overt act has been assigned against her in the entire case diary.
7. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Majhaulia P.S.Case No. 606 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
