JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 16-01-2023 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 392 of the Indian Penal Code.
Patna High Court CR. MISC. No.7652 of 2022(3) dt.16-01-2023 2/3 The allegation in the F.I.R is that the informant being an employee of shoe shop, on the fateful day, while he was returning home after collecting the amount, two motorcycles overtook him and thereafter the accused persons riding on the motorcycles snatched the collected amount from the informant and fled away. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. The petitioners are not named in the F.I.R and their names subsequently sprang up. The petitioners are in custody since 29.07.2021. Moreover, other co-accused has been granted bail by a coordinate Bench of this Court vide order dated 08.08.2022 passed in Cr. Misc. No. 21716 of 2022.
Considering the facts stated above and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the
Patna High Court CR. MISC. No.7652 of 2022(3) dt.16-01-2023 3/3 like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 173 of 2021.
