The petitioner is languishing in custody since 04.09.2018 in a case for the offence registered under Sections 363, 366(A) and 504/34 of the IPC.
The prosecution story, in brief, is that on 26.07.2018 at about 8.00 A.M, the daughter of the informant, namely, Anjali Kumari aged about 13-14 years, student of Class-IXth, had gone to coaching but did not return. It is alleged that on 29.07.2018, she has got information that one Pankaj Kumar who was talking on his Mobile Phone, kidnapped her daughter with help of his three friends and he might have sold and killed her. It is further alleged that when she went at the door of Pankaj Kumar where his parents abused her and told her to return back. It has been submitted by learned counsel for the
Patna High Court CR. MISC. No.9075 of 2019(5) dt.19-07-2019 2/2 petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is a lady. She happens to be the mother of co-accused Pankaj Kumar with whom the victim has eloped. In course of investigation, it has come that the victim and son of this petitioner (Pankaj Kumar) eloped with motive to get married. The petitioner has been made accused in the present case because she happens to be the mother of co-accused Pankaj Kumar with whom the victim had eloped.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Muzaffarpur, in connection with Maniyari P.S. Case No. 230 of 2018.
