Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 420, 323, 341, 34 of the Indian Penal Code.

It is alleged in the F.I.R that on promise to

Patna High Court CR. MISC. No.19988 of 2021(2) dt.20-12-2021 2/2 marry, the petitioner established physical relationship with the informant and continued for 3-4 years and thereafter refused to marry with the informant. The victim in her 164 Cr.P.C statement though recorded her age as 23 years but she has specifically alleged that this petitioner established physical relationship with her and continued for three years on promise of getting married with the informant and lastly denied to marry with the informant.

Considering the nature of accusation and the statement of the victim recorded under Section 164 Cr.P.C completely corroborating the prosecution version, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
