JUSTICE RAKESH KUMAR ORAL ORDER 04-03-2015 Heard Sri Y.C. Verma, learned senior counsel, who was assisted by Sri Rajni Kant Singh, learned counsel for the petitioner and Sri Pradeep Narayan Kunwar, learned A.P.P. The petitioner, who is in custody in connection with Sasaram (Mufassil) P.S. Case No. 821 of 2014 registered for the offence under Section 420, 414, 120( B) of the Indian Penal Code and Section 4 & 5 of the Explosive Substances Act since 31st August 2014 has prayed for grant of bail on parity. It was submitted that one of the co- accused having similar allegation namely Rakesh Kumar has been granted bail by this court by order dated 7.1.2015 passed in Cr. Misc. No. 52111 of 2014. It has been prayed that since petitioner's case also stands on similar footing the petitioner is entitled to be enlarged on bail.

Patna High Court Cr.Misc. No.49454 of 2014 (2) dt.04-03-2015 2/2 Learned A.P.P opposes the prayer of bail. However, he was not in a position to distinguish the case of petitioner with coaccused Rakesh Kumar who has been granted bail. Keeping in view the fact that one of the co -accused almost in similar circumstances has been granted bail, there is no reason to deny the prayer for bail of the petitioner. Let the petitioner namely Ram Janam Pal be enlarged on bail on furnishing bail bond of Rs. 10000/- (Rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S. Case No. 821 of 2014.
