JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 14-02-2025 Heard the parties 2.The petitioners are named in the F.I.R. and apprehending their arrest in connection with Ismailpur P.S. Case No. 100 of 2020 registered for the offence under Sections 147, 148, 149, 307 of the I.P.C. and Section 27 of the Arms Act.
3. The allegation against the petitioners is to open indiscriminate firing alongwith other named coaccused persons upon informant causing firearm injury alleged to having intention to cause his death, where occurrence is alleged to be arising out of long standing

Learned counsel for the petitioner submitted that the name of petitioners implicated with present case out of local village politics and, therefore, after examining all such aspects police after investigation submitted final form against these petitioners but the learned Judicial Magistrate without assigning any reason took different note and taken cognizance against this petitioner. It is further submitted that the nature of injury as alleged to be caused by accused persons appears simple in nature. While concluding arguments, it is submitted that petitioners are men of clean antecedent.
5. Learned APP, opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as police after investigation submitted final form against these petitioners where allegation of firing also appears very much general and omnibus, accordingly, petitioners above-named, in the event of their arrest or surrender before the court below within a
Patna High Court CR. MISC. No.7563 of 2025(2) dt.14-02-2025 3/3 period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge, 1st Naugachia, Bhagalpur/concerned Court, where the case is pending in connection with Ismailpur P.S. Case No. 100 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/Section 482(2) of BNSS.
