====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 26-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 20.06.2018 in a case for the offence registered under Sections 147, 148, 149, 341, 323, 302 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that on 04.05.2018 at about 7-8 A.M., informant alongwith his father Bhola Singh had gone to see his field. He saw that accused persons Mannu Singh, Sanjay Singh, Uttam Singh, Sonu Singh, Raushan Singh, Mikki Singh, Gopi Singh, Tape Singh and Mukesh Singh were digging sand and loaded the same on Tractor. They were ruining the field of the informant. When his father prohibited not to do so, Sanjay Singh ordered to kill him, then Uttam Singh and Soni

No.8440 of 2019(4) dt.26-04-2019 2/3 Singh brutally assaulted to his father by means of Iron rod, when he fell down then accused persons putting the Lathi of his neck and started pressing due to which his father died. He further alleged that when the informant tried to save him, they also assaulted him. When the witnesses came the accused persons opened fire.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. As per the F.I.R., co-accused persons are said to have assaulted the deceased with hard and blunt substance. There was no external injury found in the postmortem report. As far as the petitioner is concerned, no specific injury is attributed against the petitioner. Other coaccused has been granted bail by another Co-ordinate Bench of the Court vide Cr. Misc. No. 3315 of 2019 order dated 08.03.2019.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let

Case No. 64 of 2018.
