====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 Petitioner seeks regular bail in connection with Naubatpur P.S. Case No. 587 of 2019 registered for the offence punishable under Sections 498, 376/34 of the Indian Penal Code.

Allegation as per F.I.R. against this petitioner is that he took away the married lady to Ludhiyana and also committed rape on her.

Submission of the learned counsel for the petitioner is that her statement under section 164 Cr.P.C. was recorded which is Annexure-2 she has stated that she has not disclosed about commission of rape by the petitioner before the Naubatpur police station. It further appears that she is aged about 18 years and a married woman. Petitioner has got no criminal antecedent and he is in custody since 20.09.2019.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur in connection with Naubatpur P.S. Case No. 587 of 2019.
