2. The petitioner has preferred this application for grant of regular bail in connection with Digha P.S. Case No. 344 of 2025 registered for the offences punishable under Sections 82(1), 80, 238 of the B.N.S.
3. As per the prosecution case, the daughter of the informant was married to this petitioner, when this petitioner was already married from before. It is alleged that this petitioner tortured his daughter regarding demand of dowry, it further is alleged that on 21.05.2025, the informant got information at 10:00 A.M. that this petitioner has killed his daughter, the informant reached at the place of occurrence where he found the dead body of his daughter. The petitioner was arrested from his
Patna High Court CR. MISC. No.7902 of 2026(4) dt.09-04-2026 2/3 house. The informant alleged that this petitioner after killing his daughter threw her dead body at the Surya Mandir, Gate No. 83.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Learned counsel for the petitioner has submitted that the allegation of marriage of the petitioner with the deceased is false and in fact the deceased was having a love affair with somebody else and since there was some differences between them she committed suicide. It has further submitted that the dead body of the deceased was not recovered from the house of the petitioner and there is no eye witness to the alleged occurrence. Moreover, there are no external and internal injury on the persons of the deceased and vicera has been kept preserved to ascertain the actual case of death. It has lastly been submitted that the petitioner has no criminal antecedent and is in custody since 22.05.2025 and chargesheet has been filed in this case and there is no allegation of against tempering against the petitioner.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering the aforesaid submissions of the parties and taking into account the facts and circumstance of the
Patna High Court CR. MISC. No.7902 of 2026(4) dt.09-04-2026 3/3 case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, A.C.J.M.-IX, Patna in connection with Digha P.S. Case No. 344 of 2025.
7. The application stands allowed.
