====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 452, 307 of the Indian Penal Code and Section 27 of the Arms Act.

3. It is alleged that on 28.6.24 at about 12:30 PM while informant along with his family members were going to Ujjaini on Toto, this petitioner along with Md. Monu and Md. Tanno stopped him and asked for the seat in toto but when informant refused due to shortage of space, they assaulted informant and his family members. It is further alleged that on the same day in the night, the F.I.R. named accused persons including this petitioner, armed with deadly weapons, came at the house of informant and started firing due to which wife of informant sustained knee injury. Further allegation is that they also snatched gold chain from the neck of mother of informant.

4. Learned counsel for the petitioner submits that both parties are gotiyas and due to petty dispute, an altercation took place in which both sides sustained injuries. Allegation of assault is general and omnibus. Rest of the allegations are ornamental only to make the case grave. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1st, Naugachia, Bhagalpur in connection with Naugachia P. S. Case No. 214 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
