JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor assisted by learned counsel for the informant.

Gone through the report submitted by the learned lower Court regarding stage of the trial which speaks completion of recording evidence of seven PWs while six more are yet to be examined. Learned lower Court also shown time as six months within which time, trial is expected to conclude at the present stage.

Learned counsel for the informant submits that only I.O. is to be examined and further, the prosecution will co-operate in getting the trial concluded within the aforesaid six months. Taking into account status of the petitioner to be husband of deceased coupled with the undertaking given by the

Patna High Court Cr.Misc. No.48843 of 2014 (05) dt.30-06-2015 learned counsel for the informant as well as going through the report submitted by the learned lower Court, for the present, I do not see it a fit case for grant of bail.

Accordingly, prayer of petitioner for bail is rejected. However, if the trial is not concluded within six months, then in that event, petitioner will be at liberty to renew his prayer.
