2. The petitioner is in custody since 30.07.2014 in connection with Sasaram P.S. Case No. 648 of 2014 for the offences alleged under Sections 302 read with Section 34 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated and there is no specific allegation against him regarding the assault and the first information report has been instituted only on the basis of suspicion of the informant

4. It appears from the statement of Urmila Devi, mother of the deceased as recorded in paragraph 6 of the case diary that while the main assailant, who had fired on the deceased, was co-accused Guddu Choudhary, however, the petitioner is said
