The petitioner seeks bail in a case registered for the offence under Section 414 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act.

225.39 liters of illicit foreign liquor has been recovered from behind the house of co-accused Mithilesh Rai and apprehended co-accused disclosed the name of petitioner, as the owner of the seized liquor.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from behind the house of co-accused and petitioner has got no concern Petitioner claims clean antecedent and he is in custody since 09.11.2021. Investigation is complete.

Patna High Court CR. MISC. No.8812 of 2022(2) dt.12-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1 cum ADJ, Vaishali at Hajipur / concerned court in connection with Excise G.R. No. 548 of 2021, arising out of Lalganj P.S. Case No. 150 of 2021.
