====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 22-02-2024 Heard Mr. Umesh Prasad, learned counsel appearing on behalf of the petitioner and Mr. Syed Mojibur Rahman, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Barhat P.S. Case No. 17 of 2015 registered for the offence punishable under Sections 147, 148, 341, 307, 504 and 506 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the accused persons named therein including the petitioner had assaulted the informant, his mother and wife. Specific allegation against the petitioner is that he had assaulted by means of axe which injured the informant.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely

Patna High Court CR. MISC. No.12022 of 2024(2) dt.22-02-2024 2/2 been implicated in the case due to enmity. The allegation against the petitioner is not sustainable considering the fact that the axe blow injury sustained by the informant as per the opinion of the doctor is simple in nature.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Considering the nature of allegation made against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Barhat P.S. Case No. 17 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
