2. Petitioner apprehends his arrest in connection with Guraru PS Case No. 156/2022 dated 05.09.2022 registered for the offence punishable under Sections 379 of the IPC.

3. As per First Informant Report, a diesel pumping set kept in front of the house of the informant was stolen and the informant identified the person, namely, Ranjan Kumar who along with 2-3 persons were taking away the pumping set on a cart (Thela) from the house of informant.

4. Learned counsel for the petitioner submits that the petitioner is an innocent person aged about 19 years has falsely been implicated in this case on the basis of confessional statement of a co-accused, namely, Ranjan Kumar. She next

No.8939 of 2023(2) dt.19-05-2023 2/2 submits that the petitioner has got no criminal antecedent and he has passed his intermediate examination in the year 2021 and right now pursuing his further studies. She further submits that no stolen article has been recovered from the possession of the petitioner.

5. Regards being had to the submissions made by the parties, taking into consideration the fact that petitioner has got no criminal antecedent, he is a student and no stolen article has been recovered from his possession, I am inclined to grant anticipatory bail to the petitioner.

6. Accordingly, let the petitioner, named above, in the event of arrest or surrender within four weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Miss Puja Kumari Shah, learned Judicial Magistrate 1st Class, Gaya/the court concerned in connection with Guraru PS Case No. 156/2022, subject to the condition as laid down under Section 438(2) CrPC.
