JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 The petitioners seek regular bail in connection with Sadar P.S. Case No. 461 of 2019, registered for offences punishable under Section 395 of the Indian Penal Code. Petitioners are not named in the F.I.R., later on their names transpired on the confession of co-accused and apart from that they are accused in two more cases. It has been submitted on behalf of the petitioners that so far this case is concerned, save and except the confession of co-accused, there is absolutely nothing agaisnt them and they have been in custody since 19.11.2019 and co-accused having similar allegation has already been enlarged on bail by a coordinate Bench of this Court vide order dated 21.01.2020

Having heard both sides, in view of the submissions as above, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No. 461 of 2019, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
