JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 10-01-2018 The present writ petition has been filed for a direction to the respondents to open the bids (Technical and Financial) in the light of Tender Notice invited vide SU. JSa. BI 4150(NI-NI)16-17, Bihar, published in the daily newspaper namely, 'Dainik Jagran' dated 20.07.2016 for allotment of work for Transporting-cum-Handling Agent as per eligibility criteria laid down in the aforesaid NIT and allotted the said work of Transporting-cum-Handling Agent to the suitable and ineligible Tenderer keeping in view of extended period of original NIT by way of corrigendum dated 28.07.2016.

At the very outset this Court takes note that the petitioner has approached the respondent-District Manager, BSFC, Saran at Chapra, being aggrieved by reason of the tender not having been opened even after a lapse of more than one year and five months, a copy whereof has also been forwarded to the District Magistrate,

3. Learned counsel for the respondent-BSFC appears and has been heard.
4. Having regard to the nature of the grievance of the petitioner, the writ petition is disposed of granting liberty to the petitioner to approach the District Magistrate, Saran, who heads the District Transport Committee which has to open tenders, with an appropriate representation for redressal of his grievances. If any such representation is filed within a period of two weeks from today, the District Magistrate, Saran shall consider and dispose of the same, taking a final decision with regard to opening of the tender and dispose of the representation within a further period of four weeks thereafter in accordance with law.
