12-04-2022 Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the offence under Sections 448, 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other two F.I.R. named accused persons assaulted the husband of the informant with sharp cutting weapon(s). It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to previous enmity between the parties. In paragraph - 12 of the petition, it is stated that though, there is allegation of assault by sharp cutting weapons, but doctor has found only one injury caused by hard & blunt substance. It is further submitted that F.I.R. has been lodged after a delay of five days from the alleged occurrence and there is no plausible explanation for the same. Petitioner is

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Madhepura in connection with Murliganj P.S.
