ANJANA PRAKASH ORAL JUDGMENT Date: 19-03-2015 Heard learned counsel for the Petitioner and the State. This Revision application has been directed against the Judgment dated 18.11.2009 passed by the Judicial Magistrate, 1st Class, Gaya, in G.R. No. 422 of 2007/Tr. No. 1321 of 2008 arising out of Bodh Gaya P.S. Case No. 22 of 2007 and the order dated 26.2.2013 in Criminal Appeal No. 16 of 2011/177 of 2009(S.J.) passed by the Ad hoc A.D.J. III, Gaya, by which he has convicted the Petitioner under Section 411 Indian Penal Code and sentenced to simple imprisonment for one year.

A supplementary affidavit has been filed stating therein that the Petitioner has already been in custody for about ten months. In view of such, considering the custody of the Petitioner,

No.1083 of 2014 dt.19-03-2015 2/2 the Revision application is dismissed with modification in sentence to the extent that the period which has already undergone by him will serve the purpose of sentence at the stage of revision.
