The petitioner seeks regular bail in a case under Section 302 and other sections of the Indian Penal Code. The informant named the accused persons and alleged that Naresh Yadav fired at his brother; thereafter Binod Yadav and Karu Yadav also fired. The informant named Ram Swarup Yadav, Ram Babu Yadav, Ranjit Yadav, Girdhari Yadav and Naresh Yadav.
It is submitted that the petitioner is not named in the F.I.R. The name of the petitioner figured in the case in the confessional statement of Vikash Paswan. Vikash Paswan also disclosed the name of Manoj Paswan, who has already been granted bail vide order passed in Cr. Misc. No. 19476/2014. It
Patna High Court Cr.Misc. No.8172 of 2015 (2) dt.02-03-2015 2/2 appears that the case of the petitioner stands on the same footing. Considering the facts that the informant made specific allegation against the named accused persons about the firing and name of the petitioner figured in the case during the course of investigation in the confessional statement of a coaccused, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Magadh University P.S. Case No. 16 of 2010.
