The petitioner is languishing in jail since 09.04.2015 in a case instituted under Sections 147, 148, 448, 379, 323, 307 and 504 of the Indian Penal Code.
As per prosecution case, it is a case of attempt of murder of the informant as well as informant's family along with looting some jewellery item and also some cash by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.04.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has got no criminal
Patna High Court Cr.Misc. No.22304 of 2015 (4) dt.27-11-2015 antecedent. There is general and omnibus allegation made in the FIR. No specific overt-act has been alleged against the petitioner. The other co-accused have been granted anticipatory bail by this Court vide Cr.Misc.No.29236 of 2014.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Lakhisarai in connection with Sessions Case No.755 of 2014 arising out of Barahiya P.S.Case No.20 of 1999.
