JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-10-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 447, 341, 341, 323, 325, 307, 354, 380, 504, 506 of the Indian Penal Code.

Allegation against accused persons including the petitioners is of assaulting the informant and his family members and also took away ornaments and cash Rs.80,000/-. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to land dispute. There is case and counter case between

Patna High Court CR. MISC. No.9980 of 2020(6) dt.13-10-2020 2/2 the parties. The petitioners have got no criminal antecedent. He further submits that injury reports are simple in nature. The informant and others have granted bail by the court below itself. Learned APP for the State opposes the prayer for bail petition.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P. S. Case No. 337 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
