JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2015 Heard learned counsel for the petitioner no.2 and the State. The petitioners are accused in a case under section 376/34 and 342 of the Indian Penal Code. Petitioner nos.1 and 2 are mother-in-law and sister-in-law of the deceased Soni Khatoon. Petitioner No.1 Tilkia @ Tilkiya Khatoon, who is mother-in-law of the deceased, was earlier granted bail by order dated 3.3.2015. However, the prayer for bail of petitioner no.2 Begum Khatoon was kept pending to be considered after receipt of the lower court records.

Learned counsel for the petitioner no.2 submits that the marriage was solemnized 10 years back and the informant is not an eye witness of the occurrence. Petitioner no.2 being woman has remained in custody for more than 10 months.

Patna High Court Cr.Misc. No.47497 of 2014 (4) dt.01-07-2015 Considering the facts and circumstances of the case, petitioner no.2 Begum Khatoon is directed to be released on bail in connection with Sadar Police Station Case No.306 of 2014 on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga.
