JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners have been made accused for the offences punishable under section 376, 147, 148 and 323 of the Indian Penal Code .

The submission on behalf of the petitioners is that prior to filing of the complaint case, the complainant lodged Paraiya P.S.Case No. 55 of 2002 against the petitioners and when the aforesaid case was investigated by the police, the accusation leveled against the petitioners in the aforesaid case was found untrue and after that the complainant lodged this case.

No.53678 of 2015 (2) dt.27-11-2015 2/2 Considering the aforesaid facts and circumstances and also taking note of this fact that having more or less similar allegation one co-accused Prakash Yadav has already been granted privilege of bail by a co-ordinate Bench of this Court, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Gaya Complaint Case No. 927 of 2002.
