Petitioner seeks bail in a case registered for the offences punishable under Sections 473, 498(A)(B)(C)(D), 420 and 120B of the Indian Penal Code.
Some other co-accused were apprehended along with counterfeit coins and on their statement, name of the petitioner has surfaced.
Submission is that nothing was recovered from possession of the petitioner nor any incriminating article was recovered from his possession. Petitioner has stated on oath that he has got no criminal antecedent. The accused persons, from whose possession counterfeit notes were recovered, have already been allowed bail by a Coordinate Bench of this Court vide order dated 26.02.2019 passed in Cr. Misc. No. 7945
Patna High Court CR. MISC. No.10907 of 2019(3) dt.03-05-2019 2/2 of 2019. Petitioner is in custody since 04.10.2018. Investigation of the case is already complete.
Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Basantpur Police Station Case No. 326 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
