JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Makhdumpur P.S. Case No. 493 of 2022 registered for the offences punishable under Sections 341, 323, 452, 307, 379/34 the Indian Penal Code.
Petitioner is said to have assaulted the informant by means of iron rod causing head injury to the informant. Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. Allegation against the petitioner is that he assaulted the informant by means of iron rod , but the injury sustained by the injured is simple in nature. It is further submitted that there is case and counter case between the parties and there is admitted land dispute. It is

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, -IV, Jehanabad in Makhdumpur P.S. Case No. 493 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C.
