====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Pakridayal P.S. Case No.135 of 2013 registered under Sections 395 and 397 of the Indian Penal Code besides Sections 3/4 of the Explosive Substance Act.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the fardbeyan of the informant Ramji Das, the present case was instituted on 05.10.2013 against Jhaminder Nat alias Pagal Nat, Baldeo Nat, Jagdeo Nut alias Bagar Nut and 6-7 unknown. In course of investigation, it has only come in paragraph-50 of the case diary that the petitioner used to make the arrangement of
Patna High Court CR. MISC. No.8001 of 2019(4) dt.06-05-2019 2/2 fair at his land, where the suspected accused used to reside on putting the tent. Except that, no material has been collected by the Investigating Officer against the petitioner in course of investigation. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Motihari, in connection with Pakridayal P.S. Case No.135 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C.
