JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 24-03-2015 Heard learned counsel for the petitioners as well as learned A.P.P. assisted by learned counsel for the informant. While the deceased (Satyendra Yadav), Ritesh Yadav and Rakesh Kumar were returning from the house of Dilip Verma, M.L.A. where they have gone along with other co villagers of village Daharwa Tola as well as villagers of Gotha Tola have also arrived in order to resolve the dispute relating to pond and drainage, Satyendra Yadav was assaulted whereunder there was specific allegation against Ramdhani Ram that he

No.48142 of 2014 (3) dt.24-03-2015 2/2 repeatedly inflicted lathi blow while remaining 14-15 accused persons, so named including the petitioner, carrying omnibus allegation to have assaulted Satyendra Yadav, who was lifted by villagers to hospital where he was declared dead. From the case diary it is apparent that there happens to be omnibus allegation. Further more, from Annexure 2, copy of post mortem report, it is apparent that only two injuries were found over the head of the deceased, which after dissection found direct impact upon the meninges, which happens to be the cause of death.

Accordingly, petitioners, Amar Ram, Raju Ram, Koil Ram, Rajshri Ram, Surendra Ram, Madan Ram, Paltan Ram and Amit Ram are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran, in Shikarpur P.S.Case No. 180 of 2014.
