JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2016 Heard learned counsel for the petitioners and the State. The petitioners are in custody in connection with Daradua P.S.Case No. 118 of 2013 registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code, pending in the court of learned C.J.M., Siwan.

A report was called for from the court below regarding the stage of the case. The court below has reported that the prosecution evidence has already been closed. If both the parties co-operate, the trial of the case may be concluded within four months.

On behalf of the petitioners it is submitted that the petitioners are in custody since 21.07.2013. They have remained in custody for more than three years.

No.53705 of 2015 (4) dt.30-09-2016 2/2 Considering the aforesaid facts and circumstances of the case and the report submitted by the trial court, I am not inclined to grant bail to the petitioners and same is rejected. The trial court is directed to conclude the trial within a period of four months from the date of receipt/ production of a copy of this order. The trial court will be at liberty to conduct the case on day to day basis.
