JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 2.3.2014 in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
It is alleged that the petitioner along with Ram Jinish Rai and Vidya Sagar came to the informant and suggested that small and big mobile towers have to be installed for which security money of rupees one lac and rupees forty five thousand have to be deposited and in lieu of that the land holder will get adequate rent. Subsequently, petitioner issued cheques in favour of several persons which were deposited in the respective accounts but the cheques got bounced.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.47299 of 2014 (3) dt.05-05-2015 2/2 that there is no proof with regard to the payment to the petitioner and even assuming the accusation, no offence under section 409 IPC is made out.
From the statement made in paragraph 3 of the petitioner is appears that the petitioner is accused in five cases with similar accusation.
Considering the nature of accusation, on deposit of Rs.50000/- before the learned court below which will be invested in some fixed deposit scheme in connection with the present case which will be subject to the result of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Muzaffarpur in connection with Katra P.S. Case No. 198 of 2010.
