Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Submission is that no liquor was recovered from possession of the petitioner or house of the petitioner. Rather, name of the petitioner surfaced in the confessional statement of co-accused. Petitioner has got no criminal antecedent. Petitioner is in custody since 08.01.2021. Investigation of the case against the petitioner is already complete.

Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.19271 of 2021(2) dt.16-08-2021 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Buxar Mufassil Police Station Case No. 106 of 2019 (CIS No. 385 of 2019), subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
