JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard Learned counsel for the petitioner and the State. The petitioner is an accused in a case under sections 324, 326, 307, 120B/34 of the Indian Penal Code to which Section 302 was added later on.

It is alleged that accused Koushal Yadav opened fire at the informant as a result of which he succumbed to the injuries. The allegation of conspiracy is against the petitioner. Learned counsel for the petitioner submits that there is no overt act against the petitioner.

Considering the facts and circumstances of the case, the petitioner Ram Deo Yadav is directed to be released on bail in connection with Barhara P.S. Case No.146 of 2014 on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea.
