04-04-2018 Heard Sri Alok Kumar @ Alok Kumar Shahi, learned counsel for the petitioner, Sri Vivekanand Vivek, learned counsel for opposite party no. 1 & 2 and Sri Debesh Kumar Poddar, learned counsel for opposite party no. 3 & 4. The present petition has been filed with a prayer to restore Misc. Appeal No. 73 of 2012, which stood dismissed due to part non-compliance of peremptory order dated 20-11-2014 passed in Misc. Appeal No. 73 of 2012 alongwith Misc. Appeal No. 66 of 2012.

Learned counsel for the petitioner, by way of referring to statement made in paragraph - 3 of the petition, submits that ofcourse requisite in terms of order dated 20-11-2014 passed in Misc. Appeal No. 73 of 2012 alongwith Misc. Appeal No. 66 of 2012 was filed in respect of respondent no. 5 & 6 (in M. A. No.

Patna High Court MJC No.3164 of 2016(4) dt.04-04-2018 2/2 73 of 2012), but it was filed belatedly, not within the peremptory time. He has assigned reason for delay in filing the same. Accordingly, the restoration petition is allowed. Let Misc. Appeal No. 73 of 2012 be restored to its original file.
