Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Mashrak P.S. Case No. 501 of 2019 dated 20.11.2019 lodged under Sections 363, 302, 201, 414, 120B of the I.P.C. As per the prosecution case, there is allegation against the petitioner for commission of offence under Section 363 of the I.P.C.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Counsel submits that on 08.11.2019 at about 10:00 AM morning, the victim went outside in the name of college. But when he did not

Patna High Court CR. MISC. No.8999 of 2023(2) dt.03-05-2023 2/2 return, it has been intimated by the informant that at about 8:00 PM., he was at Chapra and thereafter, his mobile was switched off. It has also been alleged that his mobile got switched off and thereafter, victim became traceless.

Counsel further submits that there is one criminal case pending against the petitioner and he is in custody since 12.10.2022.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran in connection with Mashrak P.S. Case No. 501 of 2019, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
