Petitioner seeks bail in connection Forbesgunj P.S. Case no. 547 of 2020 registered for the offence punishable under sections 363 and 366A/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though petitioner is named in the FIR but there is no specific allegation against him even though victim in her statement under section 164 Cr.P.C has disclosed the name of the petitioner alleging kidnapping. Learned counsel further submits that victim is major. There is no eye witness to the alleged occurrence nor petitioner has been imputed either directly or indirectly for committing any overt-act. Petitioner is in custody since 30.11.2020 and charge sheet has been submitted.
Patna High Court CR. MISC. No.19297 of 2021(4) dt.15-11-2021 2/2 Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is a person with clean antecedent and neither any witness has alleged any demand for ransom nor there is allegation of establishing sexual relation on the part of the petitioner, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Forbesgunj P.S. Case no. 547 of 2020.
