JUSTICE RAKESH KUMAR ORAL ORDER 13-10-2015 Heard Sri B.P. Pandey, learned senior counsel, who was assisted by Sri Jitendra Kumar Pandey, learned counsel for the petitioner and Sri D.P. Tiwary, learned A.P.P. The petitioner, who is in custody since 28.4.2014 in connection with Buxar (Industrial) P.S. Case No. 88 of 2012 registered for the offence under Section 364, 34, 302 of the Indian Penal Code, has prayed for grant of bail.
Learned senior counsel for the petitioner submits that save and except the petitioner all other accused persons have already been granted bail. He further submits that before the court below most of the prosecution witnesses have already been examined but trial is being delayed due to non- examination of the investigating officer as well as informant of the case.
Patna High Court Cr.Misc. No.10869 of 2015 (8) dt.13-10-2015 2/2 Keeping in view the fact that trial is at the fag end, the court is of the opinion that there is no reason to extend the privilege of bail to the petitioner.
The prayer for bail stands rejected.
However, while dismissing the present petition it would be appropriate to observe that the learned court below may take appropriate steps, so that, trial may come to its logical end without unnecessary delay. The learned court below may not entertain unnecessary prayer for adjourning the case. (Rakesh Kumar, J) Praful/- U T
