The petitioner is languishing in custody since 10.10.2014 in a case registered for the offences punishable under Sections 379/34 of the Indian Penal Code.
It is alleged that the petitioner and others came on the motorcycle when informant's motorcycle and other articles were snatched by co-accused Satyanarain Baitha and Vijay Paswan. Subsequently the motorcycle was recovered from the possession of Satyanarain Baitha.
It is submitted by learned counsel for the petitioner that, though, the petitioner was named in the FIR, but
Patna High Court Cr.Misc. No.48535 of 2014 (02) dt.09-02-2015 2/2 the accusation of snatching of motorcycle is not against the petitioner.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Mali P.S.
