JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 03-03-2015 The petitioner is in custody since 21.7.14 in relation to Ramgarhwa P.S. Case No. 69 of 2014 instituted under Sections 384, 506 of the Indian Penal Code and Section 17 of Criminal Law Amendment Act.

It is alleged that while contractor was doing work of constructing the Highway, a written extortion demand was received on the pad of Communist Party of India (Maowadi). On information, police registered the case and started investigation. In course of investigation, one co-accused, Rajeshwar Ram was arrested, who is alleged to have confessed to the crime and named petitioner as instigator. Beyond this statement, there is no other material against the petitioner and there is no allegation of any other overt act.

Patna High Court Cr.Misc. No.47113 of 2014 (2) dt.03-03-2015 - 2 - Be that as it may, the petitioner, namely, Shyambabu Paswan shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the learned S.D.J.M. Raxaul at Motihari in connection with Ramgarhwa P.S. Case No. 69 of 2014.
