2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 323, 427, 448, 307, 379 and 504 of the Indian Penal Code.

3. The case of the prosecution is that the accused persons, six in number, came variously armed to the house of the informant and one Bhuteli Rai assaulted on the head of the informant, while Arjun Rai assaulted on the head of the father of the informant. Co-accused, Pika Rai and Bhim Rai (petitioner) also entered into the house of the informant and took away the article and cash from the house of informant.

4. It is submitted by learned counsel for the petitioner that it would be evident from the first information report itself that the

No.9250 of 2025(4) dt.17-06-2025 2/2 specific allegation of assault is on co-accused, Bhuteli Rai and Arjun Rai and there is no specific allegation of assault or any other overt act on the present petitioner. The allegation against the present petitioner is rather confined to entering into the house and stealing some article and cash of Rs.500/-, which appears to be ornamental allegation. It is also submitted that the injury suffered by the injured persons are simple in nature.

5. Learned APP for the State opposed the prayer for bail.

6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Akilpur P.S. Case No. 11 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Soni Shrivastava, J) Trivedi/- U T
