====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 29-09-2016 Heard Mr. Satya Prakash Sinha, learned Counsel, appearing on behalf of the petitioner, and Md. Harun Qureshi, Assistant Counsel to learned Standing Counsel No.1, appearing on behalf of the State-respondents.
The petitioner, who is the informant of Bidupur P.S. Case No.410 of 2014, by filing a petition, on 15.02.2016, in the Court of Chief Judicial Magistrate, Vaishali, at Hajipur, has sought for cancellation of bail of accused Rajendra Singh, who has been granted bail by the High Court, on 15.02.2016, in Cr. Misc. No.20161 of 2015, on the ground of violation of the conditions imposed by this Court, but the said petition has not yet been disposed of.
Patna High Court Cr. WJC No.931 of 2016 (2) dt.29-09-2016 2/2 Aggrieved by omission to pass any order on the said application of cancellation of bail by the learned Chief Judicial Magistrate, Vaishali, the petitioner has filed this application.
Considering the matter in its entirety and circumstances and in the interest of justice, it is hereby directed that the learned Chief Judicial Magistrate, Vaishali, shall deal with the application, seeking cancellation of bail expeditiously and dispose of the same, in accordance with law, preferably, within a period of one month from the date of receipt/production of a copy of this order provided that the notice, regarding cancellation of bail, is served on the accused-respondent and his bail is found liable to be cancelled.
With the above observation, this writ petition stands disposed of.
