====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-02-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Sachiwalay P.S. Case No. 05 of 2017, instituted for the offence under Section(s) 363, 365/34 of the Indian Penal Code. Subsequently, Sections 302 and 201 of the Indian Penal Code was added.
Counsel for the petitioner submits that petitioner is not named in the written report. He has no concern with the alleged Ranjana Kumari from whom it is alleged that he was having love affair. Counsel for the petitioner further submits that the girl Ranjana Kumari and other co-accused persons have already been granted bail by coordinate Benches of this Court vide orders dated 15.11.2017, 31.8.2017 and 11.01.2018 passed in Cr. Misc. 47967 of 2017, 34453 of 2017 and 803 of
Patna High Court Cr.Misc. No.10766 of 2019(2) dt.22-02-2019 2/2 2018 respectively.
Petitioner is in custody since 11.7.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Sachiwalay P.S. Case No. 05 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
