JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 03-03-2015 The two petitioners in these two applications are in custody in relation to Hussainganj P.S. Case No.107 of 2014 instituted under Section-304 B/34 of the Indian Penal Code. Petitioner-Deo Sundari Devi is the mother-in-law and the petitioner-Santosh Yadav is the husband of the deceased. It is alleged that while the deceased and her husband were sleeping in a room a small 'Dibri' (lamp) fell on the deceased and trying to extinguish it the husband also burnt severely his hands. They were both taken to hospital. They were then referred to Patna Medical College & Hospital but, on way,

Patna High Court Cr.Misc. No.47111 of 2014 (02) dt.03-03-2015 2/2 the lady died. The husband has extreme burn injury on the hands. Be that as it may, considering the facts and circumstances, let the petitioner-Deo Sundari Devi shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Siwan in connection with Hussainganj P.S. Case No.107 of 2014.

So far as the prayer for bail on behalf of petitionerSantosh Yadav is rejected. He may renew his prayer for bail after framing of charge.

In the meantime, it is the responsibility of the learned C.J.M. to see that petitioner-Santosh Yadav receives proper treatment for his burn injuries which have got complicated. Accordingly, these two applications are disposed of. (Navaniti Prasad Singh, J.) Trivedi/- U T
