Petitioner has filed this petition for a direction to the respondents not to encroach the land of the petitioner of Khata No. 73, Plot No. 1055, area 8 decimals for construction of Bharthu Branch Canal.

The respondents filed counter affidavit stating that no canal is being constructed on the land of the petitioner bearing Khata No. 73, Plot No. 1055.

In this view of the fact, I do not find any merit in this writ petition. Accordingly, the same is dismissed. (Prabhat Kumar Jha, J) Amit/- U
