JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-04-2019 This application, for grant of anticipatory bail, arises out of Sadar (Muffasil) P.S. Case No. 296/18, disclosing offences under Sections 328 and 34 of the Indian Penal Code. Allegation as per F.I.R. is that son of the informant had gone to her Sasural and while returning from there all of a sudden he fell on the ground and started crying, upon which, he was taken to hospital for his treatment and petitioners, who are mother-in-law, sister-in-law and wife respectively of the son of informant, are alleged to have administered poison to him in order to kill him.

Submission of learned counsel for the petitioners

Patna High Court CR. MISC. No.8428 of 2019(3) dt.22-04-2019 2/2 is that they have falsely been roped in the present case and a case under Section 498(A) of the Indian Penal Code and a case for maintenance is going on between petitioner no. 3 and the son of informant and, therefore, there is no occasion for the son of informant to come to house of the petitioners. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar (Muffasil) P.S. Case No. 296/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
