JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-06-2021 This case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing. The present petition has been filed for modification of the order dated 22.11.2018 passed in CWJC No. 8562 of 2018 to the extent that the time granted for payment of a sum of Rs. Four lacs be extended.
This Court by an order dated 22.11.2018 passed in CWJC No. 8562 of 2018 had granted twelve weeks' time to the petitioner to deposit a sum of Rs. Four lacs in one lump sum for the purposes of liquidation of the loan amount.
The learned counsel for the respondent Bank Shri. Suresh Prasad Singh submits that the principal amount has now stood paid by the petitioner and the only question is with regard to payment of interest on account of delayed payment of the principal amount. Having regard to the facts and circumstances of the case, this Court finds that since the petitioner has already deposited the aforesaid amount of Rs. Four lacs, which is not disputed by the learned counsel for the respondent Bank, nothing survives in the present petition inasmuch as now, no time is required to be extended since the amount in question has already stood paid, hence, the present petition stands disposed of as having become infructuous.
